PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING THIS SITE OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS OF USE. IF YOU DO NOT AGREE WITH THESE TERMS OF USE, PLEASE DO NOT ACCESS THIS SITE.
These Terms of Use apply to your access to, and use of, all or part of any website or mobile application of LendEra LLC or its subsidiaries and affiliated companies (collectively, “LendEra,” “we,” “our,” or “us”), including lenderalending.com and any other site, mobile application, or online service where these Terms of Use are posted (collectively, the “Website”). These Terms of Use do not alter in any way the terms or conditions of any loan agreement or other agreement you may have with LendEra for products, services, or otherwise.
These Terms of Use affect your legal rights, including an agreement to resolve disputes that may arise between us by arbitration on an individual basis instead of by class actions or jury trials.
The loan amount, term, and Annual Percentage Rate (APR) you qualify for are based on a credit determination and may vary depending on factors such as your credit history, income, requested loan amount, loan term, and state law. Minimum and maximum loan amounts vary by state. Not all applicants will qualify for the lowest rates or largest loan amounts advertised.
Checking your rate generates a soft inquiry on your credit report, which is visible only to you and does not affect your credit score. If you continue and submit an application for credit, a hard inquiry may be performed, which could affect your credit score.
The approval process may take longer if additional documents are requested. Approval, loan terms, and funding times will vary based on credit determination and state law. Loans may be brokered.

You agree to defend, indemnify, and hold harmless LendEra and its direct and indirect subsidiaries, and each of their respective directors, officers, employees, agents, successors, and assigns, from and against all losses, liabilities, damages, claims, and expenses, including attorneys’ fees, arising out of, relating to, or resulting from your violation of these Terms of Use or misuse of the Website.
WHILE LENDERA WILL USE REASONABLE EFFORTS TO ENSURE THAT THE INFORMATION ON THIS WEBSITE IS ACCURATE, UP-TO-DATE, AND RELIABLE, THE WEBSITE AND ALL INFORMATION, SERVICES, PRODUCTS, AND MATERIALS CONTAINED HEREIN ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE HEREBY DISCLAIMED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, TITLE, NONINFRINGEMENT, QUALITY OF INFORMATION, OR FITNESS FOR A PARTICULAR PURPOSE. LENDERA DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THIS WEBSITE IS AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
IN NO EVENT SHALL LENDERA OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR OTHER DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF BUSINESS, ECONOMIC LOSS, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR ACCESS TO THE WEBSITE OR ITS CONTENT, EVEN IF LENDERA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT SHALL LENDERA’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING FROM YOUR USE OF THE WEBSITE EXCEED THE AMOUNT PAID BY YOU, IF ANY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS. THIS LIMITATION DOES NOT APPLY TO OBLIGATIONS UNDER ANY LOAN AGREEMENT BETWEEN YOU AND LENDERA. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
Please read this provision carefully. It affects your legal rights.
YOU AND LENDERA AGREE TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT, SUCH AS ACCESS TO DISCOVERY, ALSO MAY BE UNAVAILABLE OR LIMITED IN ARBITRATION.
Any dispute between you and LendEra, its agents, employees, officers, directors, successors, assigns, subsidiaries, or affiliates arising from or relating to these Terms of Use, their interpretation, breach, termination, or validity, or the relationships that result from these Terms of Use, including disputes about the validity, scope, or enforceability of this arbitration provision (“Covered Disputes”), will be settled by binding arbitration. Disputes arising under a loan agreement are governed by the dispute resolution terms of that agreement.
Before initiating any arbitration, the initiating party will give the other party at least 60 days’ advance written notice of its intent to file for arbitration (“Notice”). Notice to LendEra must be sent as described in Section 13 below. The Notice must (1) include your name and address, (2) describe the nature and basis of the claim or dispute, and (3) set forth the specific relief sought. During the 60-day notice period, the parties will endeavor to settle any Covered Dispute amicably. If the dispute is not resolved, either party may initiate arbitration.
The arbitrator will conduct any arbitration proceedings by telephone or videoconference unless in-person appearances are requested by you or LendEra and approved by the arbitrator. The arbitrator will have the power to grant whatever relief would be available in court under law or in equity, and any award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You and LendEra agree that any Covered Dispute will be submitted to arbitration on an individual basis only. Neither party is entitled to arbitrate any Covered Dispute as a class, representative, or private attorney general action. If any provision of this arbitration section is found illegal or unenforceable, the remaining arbitration terms shall continue to be fully valid, binding, and enforceable (but in no case will there be a class, representative, or private attorney general arbitration). This arbitration provision is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1-16.
Please read our Privacy Policy carefully to understand how LendEra collects, uses, and discloses personal information, including information you provide when checking your rate or applying for a loan. These Terms of Use may not be assigned by you. LendEra may assign its rights and obligations under these Terms of Use at any time.
Should any part or provision of these Terms of Use be held unlawful, void, invalid, or unenforceable, that portion shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
Except as provided herein, these Terms of Use constitute the entire agreement between you and LendEra pertaining to their subject matter. Certain provisions may be superseded or supplemented by legal notices or terms located on particular pages of the Website, and by any loan agreement you enter into with LendEra.
LendEra’s failure to enforce any provision of these Terms of Use shall not be deemed a waiver of that provision or of its right to enforce it.
These Terms of Use and any related documents may be accepted in electronic form, and your acceptance will be deemed binding between you and LendEra.
These Terms of Use take effect when you begin using the Website. LendEra reserves the right, with or without notice, at any time and for any reason, to deny you access to the Website or any portion of it, and to terminate these Terms of Use. To help the government fight the funding of terrorism and money laundering activities, federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means for you: when you apply for a loan, you will be asked for your name, address, date of birth, and other information that will allow us to identify you.
